Unmarked material which is permitted to be taken into the examination must remain unmarked for the duration of the examination. Highlighting and underlining are permitted. Blank post-it notes can be used to mark pages. 1. Rony buys and sells second-hand Ipods. She places an advertisement on the Internet stating that she wished to buy used Ipod and was prepared to offer good prices for them. She gave her shop address and telephone number and stated that she could be contacted there during normal office hours, weekdays and sometimes on weekends. On Friday, Paul took his Ipod to Rony’s shop and she offered him £40 for it. Paul thought it was worth more, declined the offer and left the shop. However, by the time Rony arrived home Paul had decided to accept the offer of £40 and he posted a letter to her to that effect. At the same time, Rony was posting a letter Paul stating that she was prepared to pay £55 for the Ipod. Paul received the letter the following day and immediately left a message on her answering machine stating that the Ipod was sold to her for £55. On Sunday, Paul changed his mind and left another message on Rony’s answering machine stating that he no longer wished to sell the Ipod. On Monday Rony arrived at work to find the letter and the two telephone messages from Paul. Advise Rony and Paul. 2. Compare and contrast terms implied in law and terms implied in fact. 3.
