COMMON PROVISIONS SECTION 1. The Constitutional Commissions: 1. Civil Service Commission 2. Commission on Elections 3. Commission on Audit • These bodies are created by the Constitution itself and may not be abolished by statute. • Each of them is expressly described in the Constitution as “independent”. • Each of them is conferred certain powers and functions which cannot be withdrawn or reduced by statute. SECTION 2. Disqualifications. No Member of a Constitutional Commission shall, during his tenure: 1. Hold any other office or employment. 2. Engage in the practice of any profession or in the active management or control of any business which in any way be affected by the functions of his office. 3. Be financially interested, directly or indirectly, in any contract with, or in any franchise or privilege granted by the Government, any of its subdivisions, agencies, or instrumentalities, including government-owned or controlled corporations or their subsidiaries. Purpose of disqualifications: To compel the Chairmen and members of the Constitutional Commissions to: 1.Devote their full attention to the discharge of their duties. 2. Remove from them any temptation to take advantage of the official positions for selfish purposes. SECTION 4. 1.The Commissioners appointed are ineligible for reappointment for a period beyond the maximum tenure of seven (7) years; 2.Their terms of office are staggered with a two-year interval; 3.Appointment to any vacancy is only for the unexpired portion of the term of the predecessor; 4. Members of the Commission who were appointed for a full term of seven years and who served the entire period, are barred from reappointment to any position in the Commission. • Reappointment – movement to one and the same office. • Appointment – movement to a different position or office. 5. The Commissioners cannot be appointed or designated in a temporary or acting capacity; 6. The Commissioners are removable only by impeachment.
