Alfonso Lopez Jr. was arrested and charged under Texas Law with firearm possession on school premises on March 10, 1992 after knowingly carrying a concealed .38 caliber handgun into Edison High School in San Antonio, Texas. The GFSZA of 1990 made it unlawful "… knowingly to possess a firearm at a…school zone." The next day, state charges were dropped when federal agents charged Lopez with violation of the GFSZA. The respondent moved to dismiss the indictment and was denied by the District Court under the conclusion that
