Commercial speech was not protected, but people have the right to hear  This changed the law to give advertisers protection How much protection does advertising get?  Basically they give ads intermediate scrutiny Four part analysis: 1. must have some lawful activity  2. is there a substantial governmental interest  3. does it directly further the government’s interest  4. no more extensive than to achieve the government’s interest   on an exam you may see an ad that is deceptive so you have to use the FTC Standard   if you see the government trying to tell you where you can’t advertise you need to use the First Amendment intermediate scrutiny 03/15/2012
