Wally, a fireman, hears Lana make a promise to pay $1000.00 per month for one year to anyone who retrieves her dog from a blazing building and hands the dog to her. Wally rushes into the building, retrieves the dog and gives to Andrew who hands it to Lana. Lana pays Wally $1000.00 for two months before losing her jab. She explains this to Wally who tells her that, “in these circumstances” she can pay him $500 per month. She does this for three months and is then rehired. Wally wants to sue her for the $1,500.00 which she did not pay during the period she was unemployed. There is a statutory duty on firemen to do their best at all times to rescue “life or property” in danger. Advise Lana. 3.
