S THE UNIVERSITY OF THE WEST INDIES EXAMINATIONS OF APRIL/MAY 2009 CODE AND NAME OF COURSE : LAW1410 — LAW OF CONTRACT I DATE AND TIME : DURATION: 2 HOURS INSTRUCTIONS TO CANDIDATES: This paper has 2 pages and 6 questions. Answer THREE (3) Questions. Answers may be confined to the law of any jurisdiction in the Commonwealth Caribbean unless the context indicates otherwise. 1. "Parties sometimes appear to have made an agreement by the exchange of a matching offer and acceptance . In actual fact, however, the parties may have left even fundamental obligations under the agreement vague and uncertain or `to be agreed' ." Examine the contractual status of such agreements. 2. Wally, a fireman, hears Lana make a promise to pay $1000 .00 per month for one year to anyone who retrieves her dog from a blazing building and hands the dog to her . Wally rushes into the building, retrieves the dog and gives it to Andrew who hands it to Lana. Lana pays Wally $1000 .00 for two months before losing her job . She explains this to Wally who tells her that, "in these circumstances" she can pay him $500 per month . She does this for three months and is then rehired . Wally wants to sue her for the $1,500 .00 which she did not pay during the period she was unemployed. There is a statutory duty on firemen to do their best at all times to rescue "life or property" in danger. Advise Lana. 3. "A contract cannot confer rights or impose obligations arising under it on any person except the parties to it." PLEASE TURN OVER The University of the West Indies
