PRIFYSGOL ABERYSTWYTH UNIVERSITY DEGREE EXAMINATIONS 2011 DEPARTMENT OF LAW AND CRIMINOLOGY HUMAN RIGHTS: THEORIES, INSTITUTIONS AND REMEDIES (LA30510) Time allowed ONE AND A HALF hours Candidates are not permitted to bring any books, notes or any other materials into the examination. Answer TWO questions, ONE from SECTION A and ONE from SECTION B. SECTION A 1. Article 5 of the 1993 Vienna Declaration and Programme of Action states that: „All human rights are universal, indivisible and interdependent and interrelated‟. Provide appropriate theoretical and practical arguments to clarify this very general statement. 2. Is it true that „universality does not presuppose uniformity‟? Explain and discuss: a. How human rights at international and national level can reflect our common universal humanity, and b. How cultural diversity and universality theories can be reconciled for the protection of human rights. 3. Discuss and explain how the principle of State sovereignty can either support or negatively affect international action for the protection of human rights. Use appropriate examples to support both your legal and theoretical discussion. SECTION B 4. „While individual complaints systems are often hailed as the most effective means of ensuring compliance by states with their obligations under human rights treaties, it is both unrealistic and unfounded to dismiss out of hand the value of reporting systems in furthering compliance with such obligations. Each system has its own particular aims, strengths and weaknesses.‟ Discuss and illustrate all aspects of this statement. Please turn over…..
