EXAM #________________________________ Evidence, Keane, Final Exam, Summer 2011 Page 10 of 13 Section II: Essay (One Hour) Essay I Rod Bighairovich, governor of a Midwestern state, is indicted for bribery and conspiracy arising from his arranging millions of dollars in non-competitive bid contracts to be awarded to Fraudio Inc. a dummy corporation which members of Bighairovich’s family control. The prosecution presents the following: 1. Testimony of Buster, Bighairovich’s former assistant: a. He says that one day Bighairovich’s secretary told him: “The Fraudio people just dropped off a shopping bag full of cash for the governor.” b. He says that another time, Bighairovich had a severe asthma attack and Buster overheard him whisper to his personal physician as the CPR personnel put him on a gurney to get him into an ambulance, “I get these attacks every time the Fraudio people don’t come up with a payment they promised. Can you give me some tranquilizers so I don’t get so upset like this?” c. He says that one day he delivered some papers from Bighairovich to the State Attorney General. That a receptionist took the papers inside the Attorney General’s personal office and came back out. Buster waited in the reception area for any answer that might go back to Bighairovich. He heard a very irritated voice from the Attorney General’s Office say, “Can’t you, at least, come up with a better name for that bogus outfit you’ve got receiving all these contracts?” Buster then says he immediately heard Bighairovich’s voice sounding as if it were coming over a speakerphone saying, “How about golf on Wednesday?” 2. Buster is asked if Bighairovich told him how much money he made from the Fraudio scheme. He says he can’t remember, but that he once wrote it down in his pocket calendar. He identifies a page from his calendar that has a handwritten entry: “6 Mill from F Co. To RB.” The prosecutor puts the page into evidence. 3. The prosecution calls Bighairovich’s wife. She says she does not want to testify. The judge says, “You have to answer questions just like any other witness. But I won’t allow the District Attorney to ask you about any confidential marital conversations you had with your husband.” She is then asked if Bighairovich ever brought home shopping bags full of cash.
