(Between rounds, a cut man tends to cuts inflicted on a boxer during a match; usually the cut man applies pressure to stop the flow of blood and uses ice cold metal to reduce swelling.) Benny’s match was a preliminary, a warm up to the main event which was a championship bout. Carl was thrilled when the champion hired him for $1,000 to tape his hands before the championship bout. It would be calling it a little close, but he was sure that there would be enough time to complete both tasks. Unfortunately, it took so long to tape the champion’s hands that Carl missed his brother’s fight altogether. Benny is furious. He lost the match in a technical knock out because the blood streaming into his eye from a cut above his eyebrow obstructed his vision. Benny wants to sue his brother Carl for the amount of the winning purse, $5,000. Advise him. Would your advice change if you knew that Benny had promised Carl $200 for his services as cut man? Benny was so sure that he was going to win his match that he had tee shirts and baseball caps printed up designating him as the winner at a cost of $1,000. (Benny had never before lost a fight, either in or out of the ring.) They have all been donated to an overseas charity. Is Carl legally required to reimburse his brother for the cost? Why or why not? Benny cancelled a victory celebration he had planned that night at a local restaurant – dinner for twelve. The restaurant put a $50 charge on the credit card Benny had given them at the time of the reservation. Is Carl legally required to reimburse his brother $50? END OF EXAM
