Anatomy of a Lawsuit • Professional Negligence is the typical cause of action brought against nurses and/or any member of the healthcare disciplinary team. • Parties to a lawsuit: Plaintiff, Defendant(s). • The following four (4) elements must be established: • Duty • Breach of Duty • Causation • Damages • The reasonable prudent nurse standard is generally argued in professional negligence cases. • A lawsuit can be dismissed in the early stages and/or a verdict (if matter goes to trial) can be rendered in favor of the Plaintiff or Defendant. • Litigation is costly. Cases could take years to resolve. • Statute of Limitations generally 2 years.
