WITNESSETH: WHEREAS, a thorough estimation and bidding was conducted on ____________________ for the CONSTRUCTION of the Second Floor Extension; WHEREAS, time is the essence of this contract; NOW, THEREFORE, for and in consideration of the foregoing premises and other hereinafter named, the parties agree as follows: I - SCOPE OF WORK THAT the CONTRACTOR shall in accordance with the provision of and subject to the condition contained in the documents. Hereof, with a provision that this construction activity belongs to the OWNER, and in consideration of the sum of money hereinafter stated shall fully and faithfully perform all labor, and perform labor and services necessary to complete the CONSTRUCTION of the Second Floor Extension as per plan specifications of the OWNER. The work consist of the following specific work item. II - TIME OF COMPLETION The work to be performed by the CONTRACTOR under this contract shall commence after ten (10) calendar days upon receipt and acceptance of the Notice to Proceed by the CONTRACTOR. The CONSTRUCTION of the Second Floor Extension shall be completed within Ninety days (90) calendar days including holidays but excluding Sundays and . Should the CONTRACTOR refuse or otherwise fail to complete,the work stipulated herein. III - THE CONTRACT SUM Payment shall be in accordance with the following conditions: A. Upon execution of the Contract, the Owner will obligate the necessary funds to pay the contract sum in accordance with the Contract. The Owner agrees to pay the Contractor for the full and faithful performance of the work pursuant to this Contract at a sum equal to the aggregate cost of the work, labor, materials and supplies done and furnished at the price and rates set forth in the Contractor’s proposal, said sum being _____________________________________________________________ (PhP_________________). B. Advance payment shall be 30% of the total project cost equivalent to______________________________________________________________________________. C. FIRST & PARTIAL BILLING: First & Partial Billing shall be equivalent to 30% of the total project cost or equivalent to ___________________________________________________. This amount shall be released upon Thirty Percent (30%) project completion or the completion of the following items; a) 2 ND floor beams and slabs frames b) 2 nd floor wall steel frames D. SECOND & PARTIAL BILLING: Second & Partial Billing shall be equivalent to 30% of the total project cost or equivalent to ___________________________________________________. This amount shall be released upon Sixty Percent (60%) project completion or the completion of the following items; a) Roofing b) Installation of tiles c) Primer painting d) Installation of terrace railings e) Installation of Doors panels f) Installation of glass works g) Installation of electrical system E. RETENTION: All payments made by the Owner to the Contractor shall be subjected to 10% retention. Retention money shall be released after Thirty (30) calendar days from the date of turn-over of the project. IV - GENERAL CONDITION A. All materials and consumables shall be supplied by the Contractor. Ordering of materials shall be taken progressively as the need arises. B. Excess materials, scraps, scaffolds, forms, tools, equipment and other temporary structures being delivered, installed, deployed, and constructed on site by the Contractor are properties of the Contractor. C. First day of construction shall be considered Seven (7) days after the receipt of the advance payment. D. Project Time extension shall be granted to the Contractor for the accumulated unworkable days due to force-majeure and other adversities beyond the control of the Contractor e.g. bad weather. Time extension shall be based on the actual unworkable days as indicated in the “Daily Record Sheets” or log book. E. Permits & Licenses-(Not included) The CONTRACTOR hereby guarantee the works stipulated in this contract and all the materials it will apply and use in the construction as well as workmanship of all its work under this contract and shall make good of its own account and/or its own expenses. V - CONTRACT SIGNING AND ACCEPTANCE Should any court action be instituted by the OWNER or CONTRACTOR arising from this contract, the parties hereby agree.
