EXAM#____________ Page 1 of 19 Chuang: Contracts I, Final, FA 10 Final Examination Contracts I Professor Chuang Fall 2010 1. You have three (3) hours to complete this exam. It is suggested that you do the parts of this exam in the order in which they are presented and that you allocate no more than sixty (60) minutes to Part I (Multiple Choice). 2. This is a closed book exam. 3. This exam consists of two (2) parts and is worth a total of eighty (80) points. Part I consists of twenty (20) multiple-choice questions. Part I is worth a total of twenty (20) points. Please mark your responses to the multiple choice questions on the separate “ParSCORE TEST FORM” using pen or pencil and following the instructions on that form. If you change your answer, place a clear X through the wrong answer and mark the correct answer. A machine will score the exam and any ambiguities will be counted as a wrong answer. Part II consists of one (1) essay that has three (3) questions and is worth a total of sixty (60) points. You must complete all three (3) questions to be eligible for full credit. Points are awarded for organization and clarity, so take time to organize a succinct but comprehensive response. Please write your response in the blue books provided. Please write clearly. Write on every other line and every other page to permit instructor comments. 4. Write your exam number on your exam envelope. Put your correct class section and student exam # at the top of this page, each page of questions, each blue book, and the “ParSCORE TEST FORM.” Do not use your name, student ID number or Social Security Number on any exam materials. 5. At the conclusion of the exam, return all test materials, including blue books, ParScore answer sheet, scratch paper, and this exam packet to the envelope and submit it to the proctor. DO NOT seal the envelope. Students who do not return all exam materials at the end of the exam may not be graded. GOOD LUCK! This examination is intended to test only material covered in our fall semester Contracts course. Do not discuss matters we have not addressed. THESE FACTS PERTAIN TO ALL QUESTIONS: Oprah Winfrey is a world renowned television talk-show host and one of the most trusted names in television. She is famous for bestowing lavish gifts on her fans. On September 1, 2010, at the first show of the 25th anniversary season of her “Oprah” show, Oprah unveiled an incredible opportunity to her studio audience: a free trip to Australia. Over the din of her screaming audience, Oprah shouted, “This is to thank you for your loyal viewing over the last 25 years! Everyone has a ticket under their seat! Make sure to take it with you after the show!” The ticket Oprah was referring to was not a real ticket, but rather a place-holder ticket printed with the “Oprah” show logo. The place-holder ticket clearly states on the front that a new, real ticket will be forthcoming to the holder of the place-holder ticket. On the back of the place-holder ticket are the following terms and conditions: 1. This is an offer to travel to Australia for free with Oprah Winfrey. The trip will take place from November 1 to November 30, 2011. 2. A final agreement between you and Oprah Winfrey is required before you can go on the trip to Australia, along with your signed pledge never to text while driving. Although it is not illegal to text while driving in many states, Oprah feels strongly that it is safer to drive without texting. You must turn in your signed pledge before you leave the studio today. Once you turn in your signed pledge, pack your bags and call off work because you are going to Australia! 3. Oprah reserves the right to cancel this ticket if you and Oprah cannot agree to the terms of the final agreement. Austin, Betty and Cassie were three of the lucky audience members who received a place-holder ticket to Australia.
