Article 21 of the Italian Constitution provides for freedom of thought. The right to chronicle represents the truest expression of freedom of thought and an irreplaceable instrument of information at the service of the community. The internal limits of the right in question are: the social interest of the content, likelihood to reality, authentic and transparent reproduction of the news. The scope of the right of record is not related to the subject who exercises it, but to the medium through which the thought is diffused. Thus, the right to chronicle must be recognized to those who narrate facts or express a thought using a technically suitable means to inform an indeterminate circle of people. Therefore, not only to the journalist, but also to those who write in the newspaper of the school or university, on a flyer then distributed to the public, who intervenes in a forum or keeps a blog on the Internet. Even those who write on the walls of the city can invoke the right to chronicle if the other requirements are respected. The Chronicle is the through between the collectivity and the reality. Journalists being in close contact with reality, allow the community to know facts, which direct vision is hindered. The activity of the journalist serves, in special cases that do not relate to gossip, such as suicide or murder, to raise awareness of a population now disinterested. Freedom of information is a fundamental right for the journalist, that allows him to search for evidence and information that is needed for the disclosure of the news, flanked also by article 2 of the Constitution, which provides respect for the dignity of the person, and that journalists are required to follow, precisely for the protection of privacy, and that is not violated. The main cause of the media process against the suspects and the increase in the pain of the family is the length of the processes, which go on for years, and sometimes you do not get to a conviction. Finally, we must keep in mind that the third judge in Italy is the public.
